Merlin? Spokane, Washington USA (1 Viewer)

Can't decide what kind of hawk this is (see photo). Any help? It's fairly small. I didn't even realize it was a hawk until I zoomed in on the photo. I would put it's size as between a robin and a crow. I'm leaning towards a Merlin but they are rare in my area (Spokane, Washington USA).
