Why? The black back seems to be better for Tufted Duck, no?
If the question is about the male bird, what is the first image for?

A bird with the same proportions as the Tufted Duck alongside it isn't promising, and a first winter male Scaup would have grey vermiculation coming through on the upperparts. Another vote for Tufted Duck.
